FTC defines primary purpose of commercial e-mail

Washington, D.C.—The Federal Trade Commission last week announced it has determined final regulations that define the so-called "primary purpose" of commercial e-mail.

The FTC clarified that messages that are a result of a transaction with the recipient are exempt from the regulations imposed on commercial e-mail. That means marketers sending bills, account statements and e-mail newsletters, which might contain ads, are all considered transactional messages.

The Direct Marketing Association issued a statement saying it commends the FTC for the clarification and looks forward to working with the agency as it continues implementing the CAN-SPAM Act, a law that went into effect in January 2004.
