Rather Suit Against CBS Moves Forward
New York magazine reports that Justice Ira Gammerman of the New York Supreme Court in Manhattan made a preliminary ruling denying the TV network's motion to dismiss anchorman Dan Rather's $70 million lawsuit, which claims CBS unfairly shuffled him off the air after an infamous "60 Minutes Wednesday" story about President George Bush's performance (or lack thereof) in the Texas National Guard. Now that the case will be moving forward, Rather's lawyer Marty Gold wants CBS to produce internal e-mails and documents to prove his case, including exchanges between network brass and the White House. CBS lawyers have asked the court to limit the scope of the discovery by defining the case as a contract dispute.
