A federal appeals court today said a lower court was wrong to bar Business Week
from publishing documents related to Procter & Gamble Co.'s suit against Banker's Trust Co. P&G was suing to recover losses from derivative investments. BW
eventually published the documents, but appealed the original decision, arguing that it set a dangerous precedent for media gag orders. The Court of Appeals in Cincinnati ruled 2-1 that BW
should be able to use the documents because their publication would not have threatened government interests.
