Fast food marketer warns Australians about sunglasses

SYDNEY - Hungary Jack's, the Australian hamburger marketer, has been ordered by the Federal Court to take out national ads warning that the $1.60 sunglasses it sold in a national promotion last month are not safe to be worn while driving.

The ads, to run in daily newspapers in capital cities and on all national TV stations, will cost Hungry Jack's around $80,000. However, Judge Christopher Carr ordered only about half the advertising requested by the new Australian Competition and Consumer Commission. Hungry Jack's will also have to refund the purchase price of the sunglasses, if requested.

The company was found to have breached consumer product safety standards by failing to label Shades, marketed by Hungry Jack's as "really cool sunglasses" as unsafe for driving because variations in the lenses distort perception of motion.

Hungry Jack's bought 600,000 pairs of the sunglasses, manufactured in China, for 82 cents and sold about 150,000 of them for $1.60 with a meal, or separately for $4, before the promotion was withdrawn after two weeks, on October 18.
