Mark Nutritionals Agrees to Cease Ads

WASHINGTON (AdAge.com) -- A San Antonio company has agreed to cease running its weight-loss product ads and freeze its assets as a result of a Federal Trade Commission action against it.

The FTC took the action against Mark Nutritional's assets because the company, which has sold $190 million worth of products since 1999, is in brankruptcy reorganization.

The company had been heavily advertising the "Body Solutions Evening Formula" on Spanish-language radio stations. The FTC action charges that the company can not prove its claims that the product can result in the loss of as much as 20 to 40 pounds of body weight without need for diet or exercise.

The company and two officers, Harry Siskind and Edward G. D'Alesandro Jr., stipulated as part of a court hearing into FTC claims that the company could not prove its claims.
