Judge rejects NYC tobacco ad ban

A U.S. District Court judge in New York ruled federal law preempts New York City from imposing its own curbs on tobacco advertising. Judge Deborah Batts rejected a New York City ordinance barring all out-of-home advertising for tobacco products, including on-premises store advertising visible from the street. The recent tobacco industry agreement with the states bars most outdoor advertising but does not cover ads inside or outside of stores.
