Playtex Drops Injunction Request as Trial Date Is Set

CINCINNATI (AdAge.com) -- Playtex Products has agreed to cease its attempts to block Procter & Gamble Co.'s ad campaign for its Tampax Pearl tampon brand as part of a deal the marketers reached to settle procedures governing their upcoming court case.

today, Playtex has dropped its motion for a preliminary injunction that would have prevented Tampax Pearl from claiming superior comfort and protection in its current ad campaign from Publicis Groupe's Leo Burnett USA, Chicago.

The two sides also have agreed to set an expedited trial date of Feb. 3 in New York, a P&G spokeswoman said.

False advertising
Playtex sued P&G last week, charging that Tampax Pearl's superiority claims are false and that the product provides similar protection to that offered by Playtex Gentle Glide tampons. Playtex also sued P&G earlier this year claiming patent infringement over Pearl. P&G says both suits are without merit.
