Wendy's, Weightman settle out of court

Weightman Group, Philadelphia, and Wendy's International reached an out-of-court agreement last week concerning the suit Wendy's filed against the agency earlier this year in U.S. District Court over alleged inaccuracies in a post-buy analysis in the third quarter of 1993. Weightman CEO John Goodchild said: "All Weightman personnel associated with media post-buy activity for Wendy's during that period are no longer with the agency. As a result of the agreement, no further legal action will be pursued by Wendy's." Wendy's did not comment on the settlement. The $100 million agency has had a difficult year, losing some key accounts after clients' businesses were acquired by larger companies. The most recent departure is Mannington Mills, Salem, N.J., which moved its estimated $10 million commercial and residential resilient floors account to Campbell Mithun Esty, Minneapolis.
